How do I initiate a modification of child custody, visitation, or support orders in Texas?

Without Going to Court in Texas

There are multiple reasons you might wish to adjust the parenting plan (possession order) section of your court order:

  • Either you or the other parent has relocated
  • Either you or the other parent has an unusual work schedule (such as working nights or weekends) and cannot adhere to the child pickup times outlined in the order
  • You have additional children whom you need to collect simultaneously and cannot be in two locations at once
  • The key point to remember is that both you and the other parent can CONSENT to a visitation schedule that differs from the one stated in your court order. It is only necessary to adhere strictly to the order when an agreement cannot be reached.
  • Should you require assistance in forming an agreement, explore mediation and its alternatives.

Proceeding to Court in Texas

If an agreement is unattainable OR if you wish for the court order to mirror your agreement, initiate a petition to amend your order.

Any party impacted by an order is entitled to file a suit to modify the order. This generally encompasses the child’s parents, and potentially other relatives who have been designated as conservators.

A petition to modify can be contested (where parties are in disagreement) or uncontested (where parties are in agreement).
